OCEAN CITY, MD – During June of 2020, the Ocean City Police Department received numerous complaints from citizens and businesses about music being played on the boardwalk by David L. Halmon, 30, Washington D.C.
Halmon could often be found on the boardwalk near 1st Street with two speakers set up playing loud music and occasionally freestyling with two juveniles in the evening hours. Officers met with Halmon on several occasions instructing him that he needed to lower the volume of his music to a reasonable level. Halmon did not comply with the requests. Throughout the month, officers obtained noise meter readings from various distances from Halmon’s operation to support the unreasonably loud noise complaints.
Halmon’s operation created unreasonably loud noise and large crowds on the public boardwalk and the surrounding areas on 1st Street. The Ocean City Police Department applied for charges through the Maryland District Court Commissioner. Halmon was charged with ten (10) counts of disturb peace-loud noise, ten (10) counts of disorderly conduct and two (2) counts of failure to obey a reasonable and lawful order. In court, Halmon plead not guilty to all counts. The honorable Darryl G. Fletcher, Associate Judge granted Halmon probation before judgment on six (6) counts of disturb peace-loud noise. Halmon was placed on unsupervised probation for six months.
